# WICKED CLOTHES TERMS OF SERVICE

Welcome to Wicked Clothes. By using www.wickedclothes.com (the "Site") or making a purchase, you agree to these Terms of Service ("Terms"). Please read them carefully — they include an **arbitration agreement and class action waiver in Section 17** that affects your legal rights.
If you don't agree to these Terms, please don't use the Site.

## 1. ABOUT US
Wicked Clothes is operated by Wicked Clothes LLC ("we," "us," "our") and is based in North Carolina with shipping operations in Orlando, Florida.
## 2. ELIGIBILITY
You must be at least 18 years old to make a purchase, or 13 years old with parental consent to use the Site. By using the Site or placing an order, you represent that you meet these requirements.
## 3. ORDERS, PRICING & PAYMENT
- **Pricing:** all prices are in US dollars unless otherwise noted. We reserve the right to change prices, run promotions, or discontinue products at any time without notice. Pricing errors may be corrected and affected orders cancelled in our discretion (with full refund).
- **Order acceptance:** your order is an offer to buy, not a binding contract. We may accept, decline, or limit any order for any lawful reason — including suspected fraud, stock issues, pricing errors, or shipping restrictions.
- **Payment methods:** Visa, Mastercard, American Express, Discover, Shop Pay, Apple Pay, Google Pay, and Afterpay (subject to Afterpay's separate terms).
- **Pre-orders:** items marked as "pre-order" ship on the date noted in the product description. By placing a pre-order, you authorize charging your payment method at order time. If we cancel a pre-order, you receive a full refund.
- **Bundle promotions:** automatic bundle discounts (such as "Buy 3, Get 3 Free") apply at checkout. Bundle items returned individually may be subject to recalculated pricing.
- **Free items:** promotional free items (such as the free sticker pack added automatically) are not eligible for separate refund or replacement.
- **Sales tax:** collected where required by law.
## 4. SHIPPING & DELIVERY
We ship from Orlando, Florida. Standard processing is 1–3 business days. Shipping times vary by destination — see the FAQ for current estimates.
We are not responsible for:
- Carrier delays beyond our control
- Customs delays or international import processing
- Packages reported as delivered but missing once they leave the carrier (file a claim with the carrier)
- Address errors entered at checkout
International orders may be subject to customs duties, taxes, or import fees, which are the recipient's responsibility.
## 5. RETURNS & EXCHANGES
US customers can return or exchange unworn, unwashed items within 60 days of purchase. We provide a free return shipping label for US returns. International customers can return items but cover their own return shipping. See the [Returns page](/pages/returns-center) for full terms, exclusions, and instructions.
## 6. PRODUCT DESCRIPTIONS & ACCURACY
We try to display products accurately, but actual colors may vary slightly from screen to screen. We don't warrant that product descriptions, pricing, or other Site content is error-free, complete, or current. We may correct errors or update content at any time without notice.
## 7. INTELLECTUAL PROPERTY
All Site content — including designs, artwork, logos, photographs, text, graphics, and layout — is owned by Wicked Clothes or our artist partners and is protected by US and international copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, modify, distribute, sell, or create derivative works from any Site content without our prior written permission.
Independent artists license their designs to us for sale on Wicked Clothes products. Resale, reproduction, or commercial use of any artist's design (including printing on competing products) is strictly prohibited and will be enforced.
## 8. USER-GENERATED CONTENT
When you submit reviews, photos, comments, or other content to the Site (including via Judge.me reviews, social media tags, or email), you grant Wicked Clothes a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from your content, in any medium and in connection with operating, marketing, and promoting Wicked Clothes.
You represent that:
- The content is your original work, or you have the rights to share it
- It does not infringe any third party's intellectual property, privacy, or other rights
- It does not contain illegal, defamatory, obscene, harassing, or otherwise harmful material
We may remove any user content at our sole discretion.
## 9. SMS MESSAGING (TCPA NOTICE)
By opting in to SMS marketing — at checkout, via popup, or by texting a keyword — you consent to receive recurring automated marketing text messages from Wicked Clothes via Postscript at the phone number you provided. **Consent is not a condition of purchase.** Message and data rates may apply. Message frequency varies.
- **Opt-out:** reply STOP to any message to unsubscribe.
- **Help:** reply HELP for support, or email orders@wickedclothes.com.
- **Carriers:** we are not responsible for delays or failures of message delivery by your wireless carrier.

## 10. EMAIL MARKETING
By providing your email address (at checkout, via signup form, or otherwise), you may receive marketing emails from us. Every marketing email includes an unsubscribe link, and you can opt out at any time by clicking it or emailing orders@wickedclothes.com.
## 11. PROHIBITED USES
You may not use the Site:
- For any unlawful purpose
- To violate any laws (including IP, privacy, anti-spam, consumer protection, or export laws)
- To transmit malware, scrape data, automate purchases without authorization, or bypass security measures
- To impersonate any person or entity, or misrepresent your affiliation with anyone
- To collect or track other users' personal information
- To submit false orders, commit payment fraud, or initiate fraudulent chargebacks
- To harass, abuse, defame, or harm other users
- To resell our products in commercial bulk without prior authorization
We may suspend or terminate your access for any violation, with or without notice.
## 12. DISCLAIMERS
THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
## 13. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WICKED CLOTHES (INCLUDING ITS OWNERS, EMPLOYEES, CONTRACTORS, AND PARTNERS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION — ARISING FROM OR RELATING TO YOUR USE OF THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR YOUR PURCHASE WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so portions of this section may not apply to you.
## 14. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Wicked Clothes, its owners, employees, contractors, agents, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from:
- Your use of the Site
- Your violation of these Terms
- Your violation of any third party's rights
- Any content you submit to the Site
## 15. MODIFICATIONS TO THE SITE & TERMS
We may modify the Site, products, services, or these Terms at any time. Material changes to the Terms will be posted on this page with a new "Last Updated" date. Continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.
## 16. GOVERNING LAW
These Terms are governed by the laws of the State of North Carolina, USA, without regard to conflict-of-law principles. Subject to Section 17 (Arbitration), any court actions must be brought in the state or federal courts located in Mecklenburg County, North Carolina.
## 17. ARBITRATION AGREEMENT & CLASS ACTION WAIVER
**PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS.**
Any dispute, claim, or controversy between you and Wicked Clothes arising from or relating to these Terms, the Site, products purchased, or our marketing communications (each a "Dispute") will be resolved by **binding individual arbitration** rather than in court, except as expressly provided below.
- **Arbitration provider:** the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, available at https://www.adr.org.
- **Location:** arbitration will be conducted in writing or by phone unless an in-person hearing is required, in which case it will take place in Mecklenburg County, North Carolina, or another location mutually agreed by the parties.
- **Costs:** we will pay AAA filing fees that exceed the cost of filing a court lawsuit. Each party pays its own attorney's fees unless the arbitrator awards otherwise.
- **CLASS ACTION WAIVER:** **YOU AND WICKED CLOTHES AGREE TO BRING DISPUTES ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL ACTION.** The arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding.
- **Exceptions:** either party may bring qualifying claims in small claims court, and either party may seek injunctive or other equitable relief in court for actual or threatened intellectual property infringement.
- **30-day opt-out:** you may opt out of this arbitration agreement by emailing orders@wickedclothes.com within 30 days of first agreeing to these Terms, with the subject line "Arbitration Opt-Out" and including your full name, address, and email used for purchases. If you opt out, all other Terms (including Section 16) still apply.
- **Survival:** this Section 17 survives termination of these Terms.
## 18. CHARGEBACKS & FRAUD
We take chargeback fraud seriously. Initiating a chargeback before contacting us to resolve a dispute may be considered fraudulent and a breach of these Terms. We reserve the right to:
- Dispute chargebacks with documentation
- Permanently ban customers who initiate fraudulent chargebacks
- Pursue collection of amounts owed and related costs
If you have an issue with an order, please email orders@wickedclothes.com first — we resolve almost everything within 24 hours.
## 19. SEVERABILITY
If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.
## 20. ENTIRE AGREEMENT
These Terms, together with our [Privacy Policy](/policies/privacy-policy), [Refund Policy](/policies/refund-policy), and any other policies posted on the Site, constitute the entire agreement between you and Wicked Clothes regarding the Site and supersede any prior agreements on the same subject.
